Who we are

Flub is a club-membership platform: clubs ("operators") use Flub to run digital loyalty and membership schemes for their own members, at app.useflub.com and on the customer-facing pages Flub serves on an operator's behalf. Please read these Terms of Service ("Terms") carefully before creating or using a Flub account. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms, which apply to any operator who signs up for a Flub account. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Service.

Your account

You must be an authorised representative of the club you are signing up on behalf of. The information you provide us — including your name, email address, and your club's details — must be accurate, complete, and kept current. You are responsible for maintaining the confidentiality of your account credentials and for any activity that happens under your account. You must notify us immediately if you become aware of any breach of security or unauthorised use of your account.

Your club and your members

You are responsible for the content, offers, and terms you publish for your club through the Service, and for making sure they are accurate, lawful, and honoured. You are responsible for having a lawful basis to collect and hold your members' personal details, and for the club terms and privacy notice you show your members when they join — that notice is yours to write and keep current, not Flub's.

Where Flub stores or processes your members' data on your behalf (for example, names, contact details, or offer history), Flub does so as a data processor acting on your instructions, not as the party responsible for having collected that data in the first place.

Plans and billing

A club can use the Service free of charge up to a limited number of members. Beyond that, the club moves onto a paid plan billed on a recurring basis, at the rate shown on our pricing page. A valid card is required for paid plans, collected and charged through our payment processor, Stripe.

We may change Subscription fees from time to time. We will give you reasonable prior notice of any fee change so that you have an opportunity to cancel before it takes effect; continuing to use the Service after a fee change becomes effective is your agreement to pay the new amount. You may cancel your Subscription at any time from your account dashboard, or by contacting our support team.

Refund requests are considered on a case-by-case basis, at our sole discretion.

Acceptable use

You must not use the Service to publish or distribute anything unlawful, fraudulent, or misleading, or that infringes another party's rights. You must not attempt to disrupt, probe, or circumvent the Service's security, or use it to send unsolicited communications outside the club-membership purpose it is provided for. We reserve the right to suspend or terminate access to the Service for any account found to be in breach of this section.

Intellectual property

The Service and its underlying platform, features, and functionality (excluding your club's own content) are and remain the exclusive property of Flub and its licensors. You retain ownership of your club's brand, offers, and other content that you submit through the Service. By submitting that content, you grant Flub a licence to host, display, and otherwise use it solely to operate the Service on your behalf and for your members.

Third-party services

The Service relies on third-party providers to operate, including Stripe for payment processing, Apple and Google for digital wallet passes, and email and SMS providers for sending messages on your club's behalf. Your use of the Service is also subject to those providers' own applicable terms.

Termination

We may suspend or terminate your account and bar access to the Service, without prior notice, if you breach these Terms. If you wish to terminate your account, you may simply stop using the Service or contact us to close it. All provisions of these Terms which by their nature should survive termination — including ownership, warranty disclaimers, and limitations of liability — will survive.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, Flub, its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your access to or use of, or inability to access or use, the Service, whether based on warranty, contract, tort, or any other legal theory.

Changes

We may modify these Terms from time to time. If a change is material, we will give at least 30 days' notice before the new Terms take effect. Continuing to use the Service after a revision becomes effective is your agreement to the revised Terms; if you do not agree, you must stop using the Service.

Governing law
